We may update these Terms at any time, with or without notice. Your continued use of the Website or our services means you accept the revised Terms.

Mountain View Paint Pros is a locally owned painting company serving residential and commercial clients in Mountain View, California, and surrounding Bay Area communities. Our services include:
- Interior painting (walls, ceilings, trim, doors, cabinets)
- Exterior painting (siding, stucco, fences, decks, garages)
- Commercial painting (offices, retail spaces, warehouses)
- Specialty finishes (textured coatings, faux finishes, accent walls)
- Surface preparation (power washing, sanding, caulking, priming)
- Drywall repair and patching
- Color consultation
All painting work is completed by our trained team members or subcontractors working under our direct supervision.
2. Estimates and Pricing
Free Estimates
We provide free, no-obligation estimates for painting projects within our service area. Estimates are prepared using the details you share and an on-site review of the project area.
Estimate Accuracy
Pricing is based on:
- The condition of the surfaces at the time of inspection
- The agreed scope of work
- The paint products and finishes selected
- Standard surface preparation steps
Estimates remain valid for 30 days from the issue date. After that period, prices may change because of material or labor cost updates.
Additional Work
If we uncover conditions during the project that require work beyond the original scope, such as hidden water damage, lead paint, or extensive drywall rot, we will let you know right away and issue a written change order before moving forward. No extra charges will be made without your written approval.
3. Service Agreements and Contracts
Written Agreement
Every painting project requires a signed service agreement or contract before work begins. The agreement will outline:
- The detailed scope of work
- The selected paint colors, brands, and finishes
- The project schedule and estimated completion date
- The total price and payment schedule
- Warranty details
Scope Changes
Any change to the agreed scope must be documented in a written change order signed by both parties. Verbal requests or promises to change the scope are not binding.
4. Payment Terms
Payment Schedule
Our standard payment schedule is:
- Projects under $5,000: 50% deposit when signed; remaining balance due at completion
- Projects $5,000–$15,000: 30% deposit when signed; 40% at the midpoint; 30% at completion
- Projects over $15,000: Custom payment schedule described in the service agreement

- Credit card (Visa, MasterCard, American Express, Discover)
- Bank transfer / ACH
- Cash (receipt provided)
Late Payments
Final payment is due when the invoice is received unless the service agreement states otherwise. Past-due balances are subject to a 1.5% monthly interest charge (or the maximum allowed by California law, whichever is less). Accounts more than 60 days overdue may be sent to a collection agency, and you agree to cover reasonable collection expenses, including attorney fees.
Disputes
If you think your invoice contains an error, contact us within 10 business days of receipt. We will review the issue and work toward a prompt resolution.
5. Scheduling and Project Timeline
Scheduling
Project start dates depend on crew availability, weather, and material delivery timing. We will make reasonable efforts to begin on the agreed date.
Delays
We are not responsible for delays caused by:
- Bad weather, including rain, extreme heat, or high winds
- Unexpected structural or surface conditions
- Delayed deliveries from third-party suppliers
- Customer-requested scope changes
- Permit or inspection delays
If delays occur, we will communicate them as soon as possible and share an updated timeline.
Access to Property
You agree to provide reasonable access to the work area during scheduled project hours. This includes:
- Unlocking gates, doors, or garages as needed
- Clearing personal items, furniture, and fragile belongings from work areas
- Keeping pets away from the work zone
- Providing access to power and water as needed
If access is not available, the project may be delayed and standby charges for the crew may apply.
6. Surface Preparation and Conditions
Preparation Standards
Our standard prep process may include:
- Cleaning and washing surfaces when needed
- Scraping and sanding loose or peeling paint
- Caulking gaps and cracks
- Applying primer where necessary
- Masking and protecting surfaces that will not be painted
Pre-Existing Conditions
We are not responsible for conditions that existed before our work began, including but not limited to:
- Existing water damage or mold
- Structural cracks caused by settling or foundation movement
- Lead paint in homes built before 1978 (unless specifically addressed in the contract)
- Wood rot or insect damage
- Poorly installed or deteriorating siding, trim, or drywall
If lead paint is found, work in that area will stop immediately and you will be notified. Lead paint remediation requires specialized contractors and is not part of our standard services.
7. Paint Products and Materials
Product Selection
We use professional-grade paints and materials from trusted manufacturers. The exact brands and product lines will be listed in your service agreement.
Color Matching and Approval
- You are responsible for color choices unless you have hired our color consultation service.
- We recommend checking samples on the actual surface before final approval, since color can look different depending on lighting, texture, and nearby colors.
- We are not responsible for dissatisfaction with colors that were approved by the customer.
Material Warranties
Manufacturer warranties on paint products are passed through to you. We will help with warranty claims when possible, but we are not responsible for manufacturer defects.
8. Workmanship Warranty
Warranty Coverage
Mountain View Paint Pros provides a workmanship warranty on completed painting projects:
- Interior painting: 3-year warranty against peeling, blistering, or flaking caused by improper application
- Exterior painting: 2-year warranty against peeling, blistering, or flaking caused by improper application
Warranty Exclusions
Our workmanship warranty does not cover:
- Normal wear and tear
- Damage caused by the customer, third parties, or pets
- Damage from water leaks, plumbing failures, or structural movement
- Fading from UV exposure
- Cracking caused by settling, shifting, or structural defects
- Areas where the customer chose paint products against our recommendation
- Surfaces with pre-existing conditions not included in the original scope
Warranty Claims
To submit a warranty claim, contact us in writing with photos and a description of the issue. We will inspect the area within 10 business days and, if the problem is covered, complete the repair at no additional cost.
9. Cancellation and Refund Policy
Customer Cancellation
- Before work begins: You may cancel the service agreement within 3 business days of signing and receive a full refund of any deposit paid. After 3 days, the deposit becomes non-refundable but may be credited toward a future project within 12 months.
- After work begins: If you cancel after the project has started, you are responsible for payment for all completed work and materials purchased through the cancellation date, plus a 15% restocking fee on unused materials.
Company Cancellation
We may cancel a project if:
- Unsafe conditions are present on the property
- Required payments are not made
- The requested work would violate building codes or regulations
- Unforeseen conditions make the job impractical or unsafe
If that happens, you will only be charged for work completed.
10. Liability and Insurance
Insurance Coverage
Mountain View Paint Pros maintains:
- General liability insurance covering property damage and bodily injury
- Workers' compensation insurance for all employees
Certificates of insurance are available upon request.
Property Damage
We take care to protect your property, but accidents can still happen. If our crew damages your property, we will:
- Notify you right away
- Repair or replace the damaged item at our expense, or
- Reimburse you for the fair market value of the damaged item
Limitation of Liability
To the fullest extent allowed by California law:
- Our total liability for any claim connected to our services will not exceed the amount paid for the specific project involved in the claim.
- We are not responsible for indirect, incidental, consequential, or punitive damages, including lost profits, loss of use, or emotional distress.
Customer Responsibility
You are responsible for:
- Removing or securing valuables, electronics, artwork, and fragile items from work areas
- Telling us about any known hazards, such as asbestos, mold, or structural weaknesses, before work begins
- Keeping appropriate homeowner's or property insurance in place
11. Website Use
License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes related to learning about and hiring our services.
Restrictions
You may not:
- Use the Website for unlawful purposes
- Try to gain unauthorized access to any part of the Website
- Use bots, scrapers, or other automated tools to collect information from the Website
- Copy, distribute, or alter Website content without written permission
- Disrupt the Website's normal operation

Either party may file an individual action in Santa Clara County Small Claims Court for disputes within that court's jurisdictional limits.
15. Indemnification
You agree to indemnify, defend, and hold harmless Mountain View Paint Pros, its owners, employees, agents, and subcontractors from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
- Your breach of these Terms
- Your negligent or wrongful acts or omissions
- Your failure to disclose known hazards or conditions on the property
- Disputes between you and any third-party service providers
16. Force Majeure
We are not responsible for delays or failures to perform caused by events outside our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, wildfires)
- Extreme weather conditions
- Pandemics or public health emergencies
- Government orders or restrictions
- Labor shortages or strikes
- Supply chain disruptions
- Power outages or utility failures

Contractor Licensing
Mountain View Paint Pros operates in compliance with all applicable California contractor licensing requirements. Our California Contractor License Number is available upon request and displayed as required by law.

Lien Rights
Under California law, contractors and material suppliers may have lien rights for unpaid work. Paying on time as agreed helps protect your property from potential mechanic's liens.
Lead Paint Disclosure
Homes built before 1978 may contain lead-based paint. We follow all EPA Renovation, Repair, and Painting (RRP) Rule requirements. If lead paint is suspected or discovered, proper containment and safety measures will be used, and additional costs may apply.
18. Environmental and Safety Compliance
We comply with all applicable environmental rules, including:
- Proper disposal of paint, solvents, and hazardous materials
- OSHA workplace safety standards
- Local air quality management district regulations regarding VOC emissions
- EPA guidelines for lead-safe work practices
19. Subcontractors
We may choose to use qualified subcontractors for part of the work. All subcontractors are:
- Working under our direct supervision and quality standards
- Required to carry their own insurance
- Held to the same workmanship standards as our employees
You will be informed if subcontractors are expected to work on your project.
20. Severability
If any part of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
21. Entire Agreement
These Terms, along with your signed service agreement, our Privacy Policy, and any written change orders, make up the full agreement between you and Mountain View Paint Pros regarding the Website and our services. These documents replace any prior oral or written agreements.
